wesellupsidedownhomescom: "The Bank wants LOTS of information..." said the short sale Sellers - 02/23/15 03:50 AM
We are seeing a resurgence in short sales in our market. Our initial meeting includes a very comprehensive folder of information for their reference and review.  This is a confusing and upsetting time and this mini-library provides them with some resources that answer the most popular questions and concerns.  We also of course, let them know that we can be reached seven days a week should they need assistance.
Part of this "orientation information" is a list of things that the Sellers' Lender  will require when they have accepted an offer. We give them an example of a hardship letter … (13 comments)

wesellupsidedownhomescom: "The Buyer Reserves the Right to call this Offer Null and Void." - 02/05/15 05:46 PM
Short sales will never disappear from the real estate landscape completely,....there is an ebb and flow with the economy that prevents their complete extinction in addition to the hardships that sometimes are part of the paths in life.
Whether you choose to learn to list them or not....it would seem that agents who choose to write on them have an obligation to understand the process....or according to our state association...are "practicing outside of their area of expertise. "  To many of them....a sale is a sale whether you understand what you are doing or not...and that is most … (22 comments)

wesellupsidedownhomescom: "You have to Convince My Ex to do a Short Sale" Cried the Former Spouse - 01/25/15 01:48 AM
In the not so long ago....and in some cases,  continuing saga of divorce decrees, the Marital Settlement Agreement (MSA) read that within x period of time, usually 2 years or less, it was agreed that the house which was marital property, would be sold or re-financed by one member of the about to be, former couple. The same language had been used for years and became an
"automatic ending for divorce."
What was no longer "automatic"  with the decline of the housing market....was that the house had equity.
There was no option to refinance.....and the sale did not mean sharing … (28 comments)

wesellupsidedownhomescom: "I Just completed a Short Sale..Should I 'rent to own' ?" - 03/31/14 02:58 AM
Short sale sellers are used to the space that a home offers....the yard....garage that may be attached...a basement for more storage.  Now....that for a time, they will rent a house...all those "taken for granted" features are sorely missed. In southeastern Wisconsin,  unlike many other markets, we do not have many single family homes for rent.
The former short sale seller, anxious to duplicate the kind of housing that were just  left, often ask us: "Can  you find me a house that is a 'rent to own' ?"  These sorts of homes too in this market are difficult to locate.

wesellupsidedownhomescom: Underwriting and Common Sense....Hmmmm....Not Always the Case - 10/03/13 02:20 AM
We are soooo happy when our short sale sellers now become buyers...and the world that was once upside down through their own hard work is once again right side up !
It is happpening more and more frequently and we are happy to help them find the house that means so much more than the brick and mortar....it is place they start over and worked harder than they ever imagined to be able to own.
Underwriters have not quite gotten into the swing of financing this new buyer group.   Several times recently....we have gotten a call from loan … (19 comments)

wesellupsidedownhomescom: "The Bank Told us We could Keep the House...thank you for your time." Wrote the Short Sale Seller - 09/15/13 03:29 AM
The email subject line read:  "Thank you for your time". Hmmm....well there had been considerable time put in....multiple offers and counters and now we were on our way to collecting documents and submitting the short sale package to the bank.
Open the email...."We talked with the bank and we have decided to work with them and keep the house."  Good thought...not a reality....
 - Did the Bank ask you why you had missed payments ?  No
 - Does the Bank know of your pending divorce ?  No
 - Did the Bank ask if your income had changed since one … (17 comments)

wesellupsidedownhomescom: My Friend listed with a Discount Agent...And then they just want to rent..." - 07/04/13 02:40 AM
Real estate was the lunch topic of discussion....and everyone knows someone who knows more than any Realtor could ever hope to learn about real estate of course...sigh....
Soooo....my friend told me of her friend who had listed with a discount agent to say all of this money in commission. (THIS Discount agent from our experience does not return phone calls promptly and showings are set through him....sigh again.)
Querying further...."Are they down sizing..'moving out of state.....?" I asked...Oh no my friend said...they just decided they wanted to rent.

wesellupsidedownhomescom: Dear HAFA Director...I have an idea for your program..... - 06/01/13 03:27 AM
Dear HAFA Director,
We have devoted a part of our real  estate practice to short sales.  We are happy to be a part of a process that gives people the opportunity to start over…and certainly the relocation funds offered in this program are a huge help to people at a very difficult time in their lives.
The vast majority of our Sellers are very grateful that short sales are an option and they are respectful of us, understanding of the process and relieved when the transaction closes.  Wisconsin listing contracts have inclusions and exclusions. Things attached … (16 comments)

wesellupsidedownhomescom: "We Know it's Not Your First Rodeo...." Commented the Buyer - 05/21/13 04:43 AM
Sometimes Buyers do choose you as an agent because you are the listing agent.  The "argument" from a listing agent is often that the listing agent is working for the Seller so the Buyer should choose someone else to represent them.
The reasoning from a consumer may be...that the listing agent knows the house better...though a selling agent can certainly learn through observation and inspection by professionals all that they can about a house.  There are those buyers who believe too that they will undoubtedly (?)get a "better deal" if they deal directly with the listing agent.

wesellupsidedownhomescom: "Why do you DO Short Sales ?" Asked the Distressed Seller - 05/06/13 04:46 AM
Why DO you do Short Sales ?  That has to be a question that every agent who does them....has to ask some days....the days that the file is "lost"....the "negotiator" wants to add one more word to an already signed legal offer to purchase...the Selling agent "knows" you can close in 30 days.....and the list continues. Yes...there are days when you wonder why you have chosen that niche as a part of your practice.
There are emotional reasons...the hugs, the thankful tears, the ..."This is the first time I have slept in months..." remarks...
There is the honest … (12 comments)

wesellupsidedownhomescom: It is Our Respectful Honor To Be Part of A Fresh Start - 04/20/13 04:55 AM
This weekend, it is our honor and pleasure to be working with three buyers.  That in and of itself, may not sound very special. Buyers buy...we offer our services....how special can that be ?
It is special because....every one of them was a Short Sale Seller, who has worked harder than they ever thought they could to be a home buyer this weekend in less than three years and with the introduction of lenders who will help them.
Lenders that think outside the box and are able to look beyond the hard and fast goverment … (15 comments)

wesellupsidedownhomescom: “Did my Home PASS inspection ?” Asked the Short Sale Seller. - 03/09/13 03:47 AM
“Pass”….in our view, home inspections…especially those done for Short Sale homes are not a Pass/Fail issue. There may be conditions seen or unseen during an inspection that a buyer can choose to accept or not accept.
An appliance that may not be fully functioning is one thing…while tearing off a roof, installing/replacing drain tile, a failed septic system or well may be quite another.
A buyer who accepts a home in an “as is” condition takes on the responsibility for repair and replacement of things found in the inspection.
In Wisconsin, a buyer may choose … (15 comments)

Wauwatosa is a western suburb of Milwaukee, home to the Medical College of Wisconsin, minutes from the University of Wisconsin - Milwaukee (UWM) and Marquette University.  The city offers a wonderful Village with one of a kind shops and restaurants.  People locally refer to the architechture that is prevalent throughout the area as "Old World Charming"...and so it is. wesellupsidedownhomescom: "How are you an Advocate for your (short sale) Client ?" asked the Lawyer. - 02/16/13 03:35 AM
The decision to sell as a short sale...is hard ...some describe it as one of the hardest they have ever made. We understand the turmoil and stress that accompanies this decision and supply a large package of printed information to every Seller. It is comforting to be able to refer to sources and resources...guidelnes and a description of the process and what they can expect during the process of listing, approving and closing a short sale.

wesellupsidedownhomescom: Our Proudest Short Sale Moment....You WILL be Surprised ! Never Ever Say NEVER ! - 02/01/13 04:33 AM
Short sales are a part of our practice...a proud part...we see it as an opportunity to give back to the industry we love and the communities we are honored to serve. A difficult thing for Short Sale Sellers is the change in lifestyle that comes with the transition from homeowner to tenant in a smaller space. Many people come to the realization that the necessary downsizing is “just stuff.” They have salvaged, clung to and embraced the family and relationships that are most important to them. The extra furniture is just that…”extra.”
BUT…when it comes to the family pets…that … (19 comments)

wesellupsidedownhomescom: "Did you know that three other Realtors said this house was NOT a short sale ?" Asked the Attorney - 01/18/13 03:42 AM
Order in the court....part of being a REDS (Real Estate Divorce Specialist) is that you expect court appearances...depositions...swearing to...(as opposed to AT),.... I raise my right hand and swear to tell the WHOLE TRUTH....and the first question from one of the lawyers is:
"Ms Hanson....do you know that three other Realtors said that the subject property was NOT a short sale ?"
"Yes, I do." I said in a firm but embarrassed tone.
Embarrassed because....the comps clearly showed....the property condition clearly indicated.....that the property did not merit the price that the "comps" in other market analyses were … (38 comments)
