This post was inspired by Karen RittenhouseProtecting Your Property Rights

Karen's post got me to think about all the INTRUSIVE actions that are now taking place.  She makes a point about how the bills 'sound' good but questions, are they?. 

Yesterday I was out showing property and I saw quite a few homes made of brick.  Quite common for the larger parcels being partioned and sold off as separate lots.  It was common back in the day and allowed many buyers to own a small lot, and build on it.  A lot of people opted to build brick houses.  Quite a few of the house made of bricks can still be found in these neighborhoods.

Got me to think how, back in the day, a person who owned their own land could built a brick house.  There are MANY of them still standing.  I'm sure no one gave a shit rat's arse about it.

TRY BUILDING A BRICK HOUSE ON YOUR OWN LAND NOW!  TRY BUILDING ANY HOUSE ON YOUR OWN LAND NOW.  It's full of red tape. 

Times were different then.  A person's land meant just that . . . it was their's.  Now we have every ordinance, zoning, enforcements imaginable.  And more to come.

The latest:  If you own a home and it's 1978 or prior, and if you want to do any sort of remodel, etc. contractors and subs have to have a "special certification."

OMIGOSH -- what did SOCIETY do before the CERTIFICATION was mandated?!?  HOW THE HELL DID WE SURVIVE it all?? 

I read on someone's blog that there are 38,000,000 properties that were constructed prior to 1978.  I would imagine that over the years, of those 38,000,000 properties the majority have had remodeling done, repairs, upgrades . . . and ALL WITHOUT THE CERTIFICATE. 

And by the way, were any of these 38,000,000 home owners EVER consulted or asked if they wanted to have this 'Certificate" mandate enacted?  Now they're forced to hire the contractor who has the "special certifcicate."  It's a threatening fine looming over their heads, or their contractors' if they don't, and want to do any type of remodel, etc. to their home.

Hmmm . . . how'd we survive that?  But, now it's ever important for contractors to obtain this certificate.  Otherwise, the big bad wolf will come in and huff and puff . . .

My Dear Carla..... I didn't know you were a General Contractor. That is a very complimentary thing to have with a Real Estate license. That only adds to your credibility......I love this business!

Hi Carla!  You know, rules and regs have completely taken over every aspect of our lives--it's a completely different way of life now as opposed to 'back in the day.'  Very sad that, as you said, unless you have the dough, you aren't going to be baking in the build-on-your-own-land kitchen!

Sad, very sad state of affairs--and it's getting worse.

Hi Christine . . . I was talking with clients yesterday, on a home that was purchase 'cheap,' rehabbed, then put back on the market.  It was re-done quite nicely.  The owner/rehabber was there when we toured, and I told him he's lucky to have done this prior to the April 22nd mandate.  He looked at me and said, "Oh . . . don't even get me started on that . . ."

Hi Debe . . . it really is something!  I'm going to have to disclose this to all my clients on 1978 and prior properties.  I would say that the general consumer/buying public does NOT even know this.  And if they are thinking of buying an 'older' home, and don't even know about this, and hire a contractor who doesn't know ... oh brother, the ramifications are steep.  It is getting worse.

I did not hide my identity.  When I posted my comment, I included my name and my email.  If you did not receive it then you can talk to the administators of the site.

There is nothing libelous about what I have written.  Your blog does show a disdain for the law.  I did not say that you broke the law, but rather, I suggested that one who has such an attitude may be more likely to lead another in the wrong direction, hence the reason that I would not use your services.

You do not need to lecture me on the constitution.  In fact, it is good that it allows for us to speak our minds, thus providing others with some insight into our minds.  In no way have I indicated that I know all about you.

There is no reason for you to get upset, because someone has said that they would prefer not to use your services.  You could ignore it, or you could look at it as an opportunity to improve.

The Georgia legislature recently voted down a bill to allow for backyard gardens regardless of municipal requirements.  Now what?  I am supposed to throw out my tomato plants because they are a detriment to property values.  JEEZ!  Who knew my little tomatoes were the cause of all the problems!

Carla - we are in regulation overkill. I lived in Beaverton for over 10 years and am aware of the over regulation there. I believe that Washington County requires a permit to replace a wax gasket. Of course, I have lived in some counties where I wish there were some regulation. But, for all practical purposes, the fewer the regulations that better, in my opinion. Its all about control.

Matt Edwards . . .  If ypu're reading the comments at all, and the message threads, you are obviously speaking about ALL the other agents who have voiced their concerns about this ludicrous event.  Do you possess a real estate license??  If so, you are in violation of the NAR Code of Ethics.  Now, bend over and have someone pull the feather out of your arse.   Having an anonymous nobody even suggest any "improvement" on my services is a totally asinine, non sequtor, and equally libelous.

Hey Jenna -- Obviously, you shouldn't have any clients either, because of your green thumbing your nose at the "laws" LOL  READ the MATT "EDWARDS" comments ... if you've not had the pleasure.

Hi Mike . . . this, however, is a federal mandate, so it is well over the top on 1978 and prior constructed properties.  Amazing how this was okay'd.

Carla - LOL, you certainly live up to that mane of red hair.  I sometimes wonder how we ever survived without car seats and seat belts.  My 3 siblings and I would bounce from the front seat to the back seat then to the "way back" of the station wagon while Mom was driving 60 down the highway.
