It's about time,
but it's too bad you can't send someone to jail for stupidity

http://www.missionvalleycondos.infoWith all the stories about damage and theft from houses that were going into foreclosure, or in foreclosure, it was only a matter of time before one of the lenders decided to take action.

Up in Murrieta, about 75 miles from San Diego, a husband and wife pled not guilty to damage and theft from an "encumbered property." The husband is a former Marine and a current San Diego police officer. They are accused of causing $165,000 in damage and theft of $44,000 of property. The list of damage and theft from their 3,056-square-foot home is extensive:

  • The front rock facade was ripped off the house.
  • Electric wires were dug out of the walls and cut.
  • http://www.missionvalleycondos.infoA flagstone walkway and porch were removed, as was the garage door, countertops, drawers, kitchen cabinet doors, the air conditioner, gates, and even wooden beams from the interior ceilings.

According to records, on May 21 a notice of sale was posted on the house and they had until June 14 to leave. On June 15, a representative of the lender called police when the damage and theft was discovered.

I don't know if they are guilty even though their attorney said that the couple http://www.missionvalleycondos.infohad offered to return some of the property but that the lender refused. The American legal system says that they are innocent until proven guilty, and they will have their day in court. However, I didn't much care for their attorney, who also said, "How much does it cost to replace a little tile or to replace a counter top?" Too bad you can't send people to jail for stupidity.

I'm not an attorney, but I would think that if you have a house that has a mortgage on it, an "encumbered property," if the lender forecloses on your house, the house should be in the same condition as when they lent you the money to buy the house, normal wear and tear excluded.

It's about time that this crap is catching up with people.  I have been in properties like this that have been destroyed by their former owners.  I'm featuring this one in Bartender, Make it a Double.

No respect at all! I am left speechless with these sort of behavior towards property that isn't even theirs.

It will be interesting to see what happens.  There are so many people who feel justified in doing this. I toured one recently where they had spray painted everything, knocked holes in the walls, and poured cement in the plumbing.  They were not just taking things of value, merely making it very expensive to fix.

Linda – No. That one was a foreclosure, and the wife was a real estate agent her husband was the bank’s foreclosure specialist.

Roger – I hope this made the national news, though, to help wake up those stupid people.

Susan – And for some reason, when it comes to foreclosed homes and repossessed cars, that’s when people really do strange things that they otherwise would not do.

Liz – I think it is much more common than what has made the news.

Mary – All because of money. Just watch Judge Judy to see how money can tear apart families and friends, and cause otherwise normal people to do insane things.

Chris Ann – Thanks for the feature. Does that mean I get some extra points?

Will – I think some of these people still think that possession is nine-tenths of the law, so as long as they still possess it, they will do what they want to it.

Kathryn – Reminds me of the “Two and a Half Men” episode where Jake says that the school bully would rather spit in his cherry cobbler than let anyone have it. Mean for the sake of being mean, destructive for the sake of being destructive…….. just doesn’t make sense to me.
