Californians - Small Claims Court Maximum Demand Amount Upped to 10K

This could be good news, or bad, depending which side you’re on. The maximum demand amount has changed from $7,500 to $10,000.

Small claims court maximum demand increased to $10,000 under the California Code of Civil Procedures § 116.221 & 116.224 and added by S.B. 221

This bill was signed by Gov. Jerry Brown and the new increase will become effective January 1, 2012 until January 1, 2015, with further changes. Until January 1, 2012, the maximum amount is $7,500.

Thanks for sharing this little tidbit Pamela, I was not aware of it.  It could be a good thing to know about this, with some of the situations we sometimes get into.

That's an improvement. 

Virginia District Court is good up to $15,000.  However, Maryland District Court is only $5000.

Jean, isn't that the truth? You're welcome.

Lenn, it was only $5000 back in the 90's. It was a big deal when it moved up to $7500. I've heard Superior Court cases are back-logged up to 3 years, so I'm sure this change will help.

Hi Pamela - in BC, the maximum claim is $25,000.  I agree with Joni - that provides far too much enticement for spurious lawsuits!

Joni, I think small claims court fulfills a need. People have somewhere to go that doesn't require a lawyer. Generally speaking, yes, I agree too many lawsuits, especially California is a lititgious state.

Karen, wow, $25,000. I guess your higher courts don't want to be bothered with the "smaller" stuff. LOL

Wow I didn't know that.  I'm so behind that I thought it was still $5,000!  Well hopefully it will help free up the higher courts and not let everyone become even more sue happy!

Pamela -- this is important news to get out to all Californians --- not sure it will help the backlog in our overcrowded court system but it is a start.
