This guy insists on encouraging individuals to behave badly because some corporations behave badly.  He has not demonstrated that he understands one significant difference between humans and corporations.  When a corporation gets far enough underwater, it declares bankruptcy and it is dissolved.  It is history, and the principals simply seek funding and create another corporation.  I guess humans could be dissolved, but most would regard being ended as not particularly desirable.  Basically, they will not become history, but instead live with their history. Surowiecki is a writer with an imagination, generally a positive quality.  From his CNBC interview a couple weeks ago, it appears that he is also acting as an armchair lawyer giving armchair advice.
