Not all short sales listed on the Multiple Listing Service (“MLS”) are truly available to purchase. As Pacita Dimacali, Alameda County Realtor points out some sellers are just difficult to deal with. Some are even hostile!
As a San Jose short sale agent, I advise San Jose home sellers in a short sale situation that they must cooperate with the sale. I do not require a sign in the yard but I do require a lock box and full cooperation with the sale.
Sellers need to understand that they need buyers and their agents to facilitate any sale. If sellers do not intend to cooperate with the sale then there is no reason to list it on the MLS. Sellers in a short sale situation have the option of doing nothing and letting their home be foreclosed.
Foreclosure is the end result for sellers who fail to cooperate with a short sale.

Ahh, the “joys” of showing a short sale property when the hostile owner won’t leave while buyers are looking
Why is it so hard to explain to sellers that they shouldn’t be at the property when buyers and their agents are looking?
I'm representing buyers whom I've convinced to include short sales in their search. In less than a month, I’ve had to deal with hostile owners who will
- not allow a for sale yard sign
- not allow a lockbox
- insist on 24 hours notice
- not vacate the property during showings
- not guarantee an appointment for singular showing -- i.e. exclusively for the agent and buyers to see the property at a certain time
- take calls from agents but give the agents a hard time (and even hang up on the agents!)
- not keep the property in show condition. This last property had its residents still wearing their pajamas when people came to see the property. House was a mess -- there was too much clutter in all the rooms
It’s hard enough for agents to convince their buyers to see, much less write an offer, on a short sale without the seller giving them a hard time.
These sellers are literally asking for a favor -- for the bank to allow the property to be sold for less than what they owe, and for buyers agents to show their property.
Worse, they’re competing with other property owners who are surely more cooperative.
These are desperate times....these owners are supposed to be “distressed”. So why the attitude?
