When Selling or Buying What Goes With the Property

Many buyers and sellers of houses do not understand what items within a home convey with the sale of property.  First, when selling or buying a home you are purchasing real property not personal property.  If the item in question is attached to the house or ground, the general rule is the item is consider real property and conveys with the sale of property.  For example, areas of confusion with buyers and sellers are window treatments, chandeliers, gas logs in fireplaces, etc.  In most situations, these items are considered attaché to the house, and therefore convey to the buyer of the property.  Sellers need to think ahead and plan for situations that can prevent challenges and/or disagreements.  There are a couple easy steps the seller can take to prevent these types of challenges; first identify questionable property and include these items into the seller’s disclosure, stating these items do not convey with the sale of the property.  Remember, the seller’s disclosure becomes an addendum to the contract.  Second, post a sign near or on the items the seller wishes not to convey.  In conclusion, if there is anything that is nail or screw to the interior or exterior of the structure, or must be uproot from the ground, then you should follow the above recommended procedure.

I always tell sellers that if they intend to not sell something like a light that is attached to the house to remove it before buyers see it.  Save the confusion.
