Miami-Dade County Certificate of Use - Update

(The following information is for Miami-Dade County only, and no other part of the State of Florida is effected)

Miami-Dade County passed a Certificate of Use (CU) Ordinance in December 2008. The intension was to inform Buyers of foreclosed property of the real condition not just the standard "As-Is" clause. This ordinance will only cover unincorporated Miami-Dade County, not the surrounding 30 plus municipalities. The expected effective date for enforcement of the ordinance will be April 1, 2009.

At this point the process starts after the Loss Mitigation Department (Bank) takes control of the property. A licensed architect or engineer must inspect and document that the structure is the same as the original plans on file with Miami-Dade Building Department. They will also document the condition of the structure and any repairs needed to bring the structure up to code and in compliance. This document will include an estimate of the cost for all repairs needed.

The report will be reviewed by the Building Department. Once the application and reports have been reviewed and approved they need to take the document to the Clerk's Office so that can be recorded into Public Record. With proof of recording the Building Department should then approve your Request for CU. All the steps above must be completed before the first offer can be accepted by a Realtor.

It is hoped that this ordinance will prevent future problems for potential Buyers that won't do the homework required before the purchase of a new home.

Chuck, I am hoping this ordinance was vetoed today by Mayor Alvarez.  It was created with the best of intentions, but even before being fully implemented, has become another hurdle in the buying process.

Hi     As you know, effective April 1, begins the application of Ordinance 08-133 related with the new certificate of use  for properties acquired by foreclosure in unincorporated areas of Miami Dade County   I am a professional engineer with registration in the State of Florida doing certified building inspections   The price for the disclosure of findings report will be 799.00 (subject to change in the future)    When a property has a swimming pool, it is necessary to empty it, in order to evaluate the structure, then an extra charge is required   During and after the inspection.. New Certificate of Use Requirement for the Sale of Foreclosed Properties


Effective April 1, 2009, buyers of foreclosed properties in unincorporated Miami-Dade County will get some protection against unexpected repairs or other deficiencies of the property under an ordinance adopted by the Miami-Dade Board of County Commissioners (BCC) on December 2, 2008.

Ordinance No. 08-133 applies to all residential properties in unincorporated Miami-Dade County which are acquired through a Certificate of Title (Foreclosures and Judgments), in accordance with Chapter 45, Florida Statutes. Residential properties affected include single-family homes, condominiums, townhouses and duplexes.

The adopted ordinance requires that title holders of foreclosed properties obtain a Certificate of Use (CU) prior to offering the property for sale, transfer or alienation.

Turn Key Certificate of Use Process

The Certificate of Use Process requires a multipronged approach in order to provide the level of efficiency that Property Assessment Group can offer.

 

Submission of Property Information:

The Asset Manager or Real Estate Professional enters the required property information onto a database, from there the information is populated onto Property Assessment Group’s inspection reports, limiting the possibility of errors in manual translation onto a hand written report.

 

Surveying

            Once the information is received a surveyor is sent out to create a new certified survey.

 

Zoning Verification

            Running concurrently with the Survey a zoning analyst will review required zoning information and compare it to the archived zoning information for the year in which the home was built. If the survey team finds a structure within a current setback, the zoning analyst will obtain a letter from the Department of Planning and Zoning which will state any and all variances on the property, this service is included for no additional cost.

 

Property Inspection 

            The Licensed professional Architect or Engineer will inspect the property and fill out the Disclosure of Findings Report required by the county in order to obtain the Certificate of Use for the property in question. Once completed the Architect or Engineer will sign and seal the document attesting to its accuracy.

 

Violation Consultation

            If violations are found the Architect or Engineer will present those to the owner and offer a professional opinion on the best course of action, armed with that information the owner would be better able to make a decision on whether to bring the current structure up to code or submit the report to obtain a Certificate of Use, and be authorized to sell the property. This service is also offered at no additional cost.

 

Processing and Filing of the Certificate of Use.

            At this point the certificate of Use Process is at the final stages, our dedicated Processing and Filing team will submit all required information and be on hand to ensure that as reports are approved they are delivered to the clerks office for immediate filing and processing. The CU number is then recorded and a record copy is electronically sent to the owner for record keeping along with the approved Certificate of Use.

To answer the question of how long the process takes, I'm hearing that it will extend the process about one month. As for your question if the inspection is complete, I see at least 3 more steps that can be complete as quickly as a few days.  The first step after the inspection is complete is to return to Building and Zoningand let them review/approve the inspection. The second step is to have the inspection recorded in Public Record and the last step is to then return to the B&Z with proof that you have recorded the documents at this time B&Z should issue a Certificate of Use. The of couse is very simplifed just for showing the step need to complete the process. You will always find speed bumps in the way.

Miami Dade Certificate of Use. 

The Certificate of Use enforces that the foreclosed property meets the zoning and building regulations in compliance with the Code.

Our Certificate of Use is obtained by a Company meeting all the requirements enforced by State of Florida and Miami Dade County.

Certificate of Use Inspections 

We have mandatory Certificate of Authorization from State of Florida (in our case Board of Professional Engineers) to "offer" and perform Engineering Services (same applies to architectural companies). Florida Statutes (F.S.) 471.023.

We have mandatory Local Business Tax to conduct this type of business in Miami Dade County. Chapter 8A, Article IX, Sec. 8A-171, Code of Ordinances.

 

Quality Control for Certificate of Use.

The owner of the company is a Professional Engineer and every report for Certificate of Use is reviewed before submission. A few companies have a Professional Engineer or an Architect as the owner.

 

Boundary Survey for Certificate of Use. 

Miami Dade County local government has not enforced the use of a Boundary Survey to obtain Certificate of Use.

Always have been our opinion that a Boundary Survey must be a requirement to obtain Certificate of Use.

The drawing cannot be a simple addition of lines because statements on page #2 in the report for Certificate of Use depend on the measurements of the property stated in the map.

Our field works and drawings had been always made by professionals in the surveying activity and our final map is always reviewed and approved by a Professional Land Surveyor and Mapper before to be signed by a Professional Engineer.

It is practically impossible to have a true measurement of a setback if the drawing-map does not follow the minimum standards for a Boundary Survey required by State of Florida.

We have followed those standards in our drawings but we want to emphasize that measurements in our drawings cannot be considered final. Regardless the signature in the drawing (Professional Engineer or Professional Land Surveyor and Mapper), that drawing is only valid to obtain Certificate of Use and cannot be use for other purposes.

We provide an Engineering Survey because we cannot increase our fees to offer our service when a Boundary Survey is not an official requirement.

Our Engineering Survey or Site Plan signed and sealed by a Professional Engineer might be converted into a Boundary Survey signed and sealed by a Professional Land Surveyor and Mapper.

 

Certificate of Use, Miami Dade Code.

The person or entity listed upon a Certificate of Title issued pursuant to Chapter 45, Florida Statutes as the purchaser of a single-family residence, condominium unit, townhouse or duplex shall obtain a Certificate of Use (CU) from the Department prior to offering said residence for sale, transfer or other alienation.

The Certificate of Use required by this subsection shall be for the purpose of determining whether or not the residence in question complies with all building codes and zoning codes applicable to the residence and to provide a disclosure of those findings.

The Director shall require disclosure by requiring an inspection of the property by personnel authorized to conduct such inspections by the Director and to subsequently record in the public records of Miami-Dade County the inspection report.

Said report shall include a good faith estimate of the cost to repair or remedy all code violations disclosed by the inspection.

The Director shall prescribe the form of the inspection report and disclosure to ensure compliance with the intent of this section.

Upon the recording of the inspection report and estimate in the public records of Miami-Dade County, the Director is authorized to issue the Certificate of Use required by this subsection (c).

The Director shall refer any County Code violations disclosed in the report to the proper County Department for enforcement action.

County Departments are authorized to collect fees for inspections and other administrative costs and/or for the issuance of the Certificate of Use, as maybe applicable, and as established in the departments' approved schedule of fees.
