MLS Should Be Only Source of Syndication or Risk Bait and SwitchYesterday, I was contacted by a buyer I am currently working with who is looking to buy a home in Brentwood TN. He is feverishly hunting for his new home on Zillow. Yes, I have warned him of the dangers doing so. However, yesterday's email to me revealed a new problem that Zillow may not have anticipated.

Zillow has made it easy for sellers and agents to enter listings onto their site directly and syndication from other sources, rather than just syndicating them from the MLS. I'm sure this was another attempt on their part to gain marketshare by having the most listings on their website.

The email I received included the following Zillow link:

Of course, my first action was to go to my local MLS to see if the home was still available. Below is the MLS listing for that address as it appears on my website:

If you look at the photographs, you will see they aren't the same. Not only aren't the photos the same, the price isn't the same either. When I clicked back to the Zillow listing, I discovered there wasn't an MLS number. Hmm, that was curious. What agent wouldn't include an MLS number?

The Zillow listing provided a link to a virtual tour so I clicked that. Only to find that the virtual tour actually took me to a real estate agent's website. However, it wasn't the listing agent's website who actually has 8107 Hilldale listed.

Apparently, another agent has hi-jacked this listing address and posted it on Postlets with different listing details, photos and description. That listing was then picked up by Zillow through syndication. I suspect if you contact the agent who co-opted this address, he will tell you that home isn't available but he can help you build a different home in another location.

I alerted the listing agent to this. He has contacted the agent who hi-jacked his listing and demanded that agent take down the listing from Zillow and any other location. I have also reported this to Zillow myself. As of yet, the bogus listing hasn't been taken down. If you Google this address, other sites have already syndicated the hi-jacked listing.

Now, some of you may be thinking how is this different from syndicating your listings to other agent's websites. There is a difference. When my website picks up a new listing, it does it from the MLS feed, not any other source. Therefore, the photographs and descriptions found on my website are the same exact photos and descriptions entered into the MLS by the listing agent. The Listing Broker's name is even displayed at the bottom of the listing page.

What this agent has done is use the address of an active listing and then changed the photos and description of a home he hopes to build for a buyer. However, he doesn't own the land used or hold the listing he is advertising as his. He directs buyers from that listing to his website hoping to pick up business. He's using an active listing address to attract buyers to his site. It's basically a bait and switch scam.

Since Zillow doen't appear to monitor the listings that are syndicated to their website from other sources, anyone could do this same thing. This is similar to the Craig's List rental scams we've seen. What's really shocking is this particular bait and switch was perpetrated by another agent, an agent who is with ReMax Elite. 

The MLS should be the only source of syndication or risk bait and switch scams. Just another reason why buyers should be leery of any listings found on Zillow's website or any other aggregate sites for that matter. It is best to work directly with a local real estate agent who can send you real listings as they come on the market.

NOTE: In response to the complaint made, Zillow has removed the bogus listing.

4 homes were sold in Brenthaven in February 2014. They ranged from 3-5 bedrooms and 2-3.5 baths. The smallest home had 1,800 square feet, was not updated, and sold for $320,100. The largest home had 3,052 square feet, was not updated, and sold for $480,000. They were all built in the 1970’s and sit on acre lots.

The Average days on market were 47 days and Average Sales Price was $388,775. The average sales price was 97% of the list price. This neighborhood continues to be a seller’s market.

February 2013 statistics reveal 1 sale. This was a short sale in a newer section of the neighborhood. It had 4 bedrooms, 3.5 baths, 3,454 square feet, and sold for $415,000.

The 2 Under Contract listings were both built in the 1970’s and have not been updated. One has 2,125 square feet, 4 bedrooms, 2 baths, and is listed at $365,000. The other has 2,560 square feet, 5 bedrooms, 3 baths, a basement, and is listed at $429,900. They are both on acre lots.

The 1 Pending listing was built in 1976, has 4 bedrooms, 3.5 baths, 3,052 square feet, a basement, and has minimal updates. It is listed for $475,000 and the lot is just over an acre.  

The 1 Active listing was built in 1969, has 3 bedrooms, 2.5 baths, a basement, and an in-ground pool. It has not been updated. It is on an acre lot and is listed for $399,000.

January 2013 statistics also reveal 0 sales. Zero sales for January, both this year and last, is not a surprise as the winter months are generally a slower selling/listing season.

7 homes were sold in Brenthaven in December 2013.

Two were 3 bedroom/2 bath homes built in the 1960’s and between 2,000 and 2,500 square feet. One of these was a foreclosure and in need of renovation and the other was completely renovated.

Three were 4 bedroom/2.5-3.5 bath homes built between 1972 and 1981 and between 3,000 and 4,000 square feet. Two of the three of these homes were renovated and one of those renovated homes had a contract prior to going on the market.  

The last two homes were 5 bedroom homes, but the similarity stops there. One was built in 1976, was renovated, had 2,510 square feet, and had a closed room concept. The other was built in 2002, had 5.5 bathrooms and 5,215 square feet, including a basement, and had an open concept.

 The average size of all sales was 4 bedrooms with 3 baths and 3,150 square feet. Average days on market was 42 with the maximum amount being 96.

The lowest priced home, the foreclosure, sold for $25,500 over list price. The highest priced home sold at 98.7% of list. The average sale price was $456,771. This neighborhood continues to be a seller’s market.

In comparison, December 2012 figures reveal only 1 sale with a sales price of $265,000. This was an older home in need of renovation.

Three homes were sold in Brenthaven last month. The lowest priced home sold at $375,000, had 5 bedrooms (2 in basement) and 2 baths and was built in 1970. The median priced home sold at $495,000, had 4 bedrooms and 3 baths and was built in 1976. The highest priced home sold at $545,000, had 4 bedrooms and 3.5 baths and was built in 1984. They averaged 3,814 square feet. Their lot size was approximately 1 acre.  Average days on market were 56 with the maximum amount being 126. All of these homes had minimal if any updating.

The average sale price to list price was 96.6%. The average sale price was $471,666. The highest sale sold for $100 over list price. This neighborhood continues to be a seller’s market.
